The agreement that governs our planners, website, and app.

1. Acceptance of These Terms

These Terms of Use ("Terms") form a legal agreement between you and Polite Fish ("we," "us," or "our") and govern your use of the website at www.politefish.com, our web-based planner configurator, our digital planner products, and the Polite Fish Planner app for iPad and iPhone (together, the "Services"). By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

For information about how we handle your data, please also review our Privacy Policy, which is incorporated into these Terms by reference.

2. The Services

Polite Fish provides personalized digital planners and journals. Depending on the product, these are delivered as PDF files (sold through Etsy and built with our configurator) or created within the Polite Fish Planner app. The app lets you design planners and travel journals, write and draw on them with Apple Pencil, add stickers, and back up and sync your work through Apple iCloud.

3. License to Use Our Products

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use our planners, templates, and the app for your own personal or internal business planning. You may not:

  • Resell, redistribute, sublicense, rent, or share our planner files, templates, or app content;
  • Reproduce or repackage our designs to create competing products;
  • Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by applicable law; or
  • Use the Services in any unlawful way or in violation of these Terms.

All planners, templates, designs, text, graphics, logos, and software that make up the Services are owned by Polite Fish or our licensors and are protected by intellectual property laws. We reserve all rights not expressly granted to you.

4. The Polite Fish Planner App

Your content

You retain ownership of the planners, journals, handwriting, drawings, and other content you create in the app ("Your Content"). Your Content is stored on your device and, when iCloud is enabled, in your own Apple iCloud account. We do not access, collect, or store Your Content on our servers. You are responsible for maintaining your own backups; while iCloud provides redundancy managed by Apple, we are not responsible for any loss of Your Content.

Acceptable use of the app

You agree to use the app only for lawful purposes and not to interfere with its operation, attempt to circumvent subscription controls, or use it to infringe the rights of others.

5. Subscriptions and Billing

The app is free to download and includes a free tier with limited functionality. Certain features require Polite Fish Pro, an optional auto-renewable subscription.

  • Billing: Polite Fish Pro is an annual subscription. The price is shown in the app at the time of purchase and is charged to your Apple ID account upon confirmation of purchase.
  • Auto-renewal: Your subscription renews automatically for the same period unless it is canceled at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
  • Managing your subscription: You can manage or cancel your subscription at any time in your App Store account settings. Canceling stops future renewals; the subscription remains active until the end of the current paid period.
  • Refunds: All purchases and subscriptions in the app are processed by Apple. Refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We do not process payments and cannot issue refunds for in-app purchases.

6. Purchases Through Etsy

Our PDF planners are sold through Etsy and are subject to Etsy's terms and policies in addition to these Terms. Because our planners are personalized, made-to-order digital goods, please review the refund and cancellation information on the relevant Etsy listing before purchasing. Order communications and transactions for Etsy purchases are handled through Etsy.

7. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any content you create will not be lost. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

To the maximum extent permitted by law, Polite Fish and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us (or to Apple for in-app purchases) in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Apple App Store Terms

The following terms apply to your use of the Polite Fish Planner app obtained from the Apple App Store ("App Store Sourced Application"):

  • Acknowledgement: These Terms are between you and Polite Fish only, and not with Apple. Apple is not responsible for the app or its content. Your use of the app must comply with the App Store Terms of Service.
  • Scope of license: The license granted to you for the app is a limited, non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support: Polite Fish is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance and support services with respect to the app.
  • Warranty: Polite Fish is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
  • Product claims: Polite Fish, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property rights: In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Polite Fish, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms: You must comply with applicable third-party terms of agreement when using the app.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Washington, except where prohibited by applicable law.
